If I were to report here all of the side issues, charges, and counter-charges made in connection with this dispute it would be an extremely lengthy and complicated report.
Jack E of Luton, England, tried to withdraw $850 from his account at the Bingo Las Vegas Casino (BLVC). The casino refused, pointing to a provision in its Terms & Conditions prohibiting two players from using the same IP. After Gambling Grumbles wrote to it, it refunded his last deposit ($150), which he had never played with, but refuses to pay the remaining $700.
Jack is a university student and goes on line on his campus. Just as in a hotel, airport, or public cafe, he is given one of the IPs assigned to that location. Tomorrow, somebody he has never even met may get the exact same IP. BLVC found another player, who is registered with the user name of Grandthrax, who has used the same IP as Jack.
BLVC asked Jack if he knew Grandthax, and he said he didn't. The casino then went to Jack's Facebook page, identified Grandthax by his picture (which is on file with the casino), and determined that Jack had lied to it about knowing him.
Jack says that he was only asked if he knew someone named "Grandthax" and was not told the person's real name. He contends that he had no idea that his friend and Grandthax were one and the same. The casino does not accept that.
In a series of letters which were alternately professional; sarcastic ("maybe he is not quite sure where in England he is precisely hmmm.. If that is the case then there is more problems than we initially imagined"); and threatening ("we understand that eventually, complaints from players may result in our Company having to go as far as taking legal action against those who illegally Slander and take Malicious action against us. All parties, individual or otherwise, are subject to these international business ethic laws") Cindy, who handles Player Relations for BLVC, told Gambling Grumbles that 'We conducted a phone interview with Mr E_____ and asked him if he knew the other registered user, and he stated he did not. Well in fact, he lied."
You can get an idea from the above about what I mean when I said this dispute became complicated and involved a number of side issues. So let's boil it down to the basics:
Did Jack and Grandthax use the same IP? Probably, but that should not matter. There are undoubtedly many others on that campus who use that IP.
Did Jack know Grandthax? Yes -- at least under his real name.
Did Jack know that Grandthax plays at BLVC? It is Jack's word against the casino's, but this really is unimportant. Jack's record at the casino was a losing one until his last series of games. It does not seem, nor has the casino contended, that Jack and Grandthax in any way conspired to cheat the casino.
Gambling Grumbles tried to mediate this dispute. We suggested the following: That BLVC pay Jack the $700 he won (which would be a lot cheaper than the law suit it has been threatening), lock his account, and that Jack, in turn, agrees to go to any website where he has posted complaints about BLVC and state that he was paid everything due him.
Jack agreed.
Cindy did not answer.
