Small in money terms but with a large problem

When Tim G of Germany first sent us his grumble we were certain that it would be resolved easily. Now our suggested ending is apt to be refused by one or both sides.

Tim began playing at Spinit in February and won 2472 Euros. His documents were approved in mid-March but it wasn't until 11 July that he was paid -- but only 2300 Euros.

"I inquired with the casino about the rest of my win and on the 7th of September I was informed that the rest will not be paid to me due to the breach of terms," he told us. "The casino never provided the clear reason for not paying me the rest. I understand this is not a big amount, but I would still like to get the rest of my win".

Okay, this sounded simple enough. With Spinit having paid 2300 Euros we could be certain that it was not trying to cheat Tim. Additionally, we felt that if there was a violation of its T&Cs it would have had to be a minor one, like making a single bet during his bonus play which resulted in a 172 win.

We asked Spinit to either pay Tim the remaining money or explain why it will not. The answer we got surprised us:

"What the player is not saying is that he never sent in the documents we requested from him. The 2300 were paid in error without having yet received the proper documentation."

In further discussions we were told that Tim did send in documentation, including a passport, but the casino believes them to be fake -- it wants a notarized copy of his passport before paying him.

If Tim lived in the US, where he could walk into his bank and an assistant manager would notarize the passport at no charge, this would not be a problem. In fact, in many countries notaries charge only nominal amounts for their services.

Germany is not one of those countries. We checked on the internet and found that German notaries are either lawyers or paralegals whose fees are set by the country and are both high and not negotiable.

We have run into a similar problem before. In 2010 Club World believed that a notarized passport sent to it by a London player was a fake. We suggested that Club World choose any notary in the city that it wants, have the player get his passport notarized by that notary, and then, if still not satisfied, phone the notary to get confirmation.

Our suggestion, which Club World accepted, was both time consuming and expensive for the player but he was willing to agree to it for a simple reason: the casino owed him 29,535 GBP (which in those days translated to 33,703 Euros or US $45,312). In the end, Club World was satisfied and the player received the entire amount.

However, 172 Euros is a different story completely. Even though Spinit is not requiring that a particular notary handle Tim's case, is it truly worth his time and money to go to one?

Our suggestion -- which, as noted above may well be rejected by one or both sides -- is that Spinit name a notary in Tim's city (a list can easily be found on the internet) and that it agrees that if the notary confirms the validity of Tim's passport, the casino will pay the notary's charges.

The casino may refuse this suggestion because it increases the risk of how much it may have to pay. Tim may refuse it either because the 172 Euros is not worth his time or, if Spinit is right about the passport he sent it being a fake, this would prove it.

Still, given the high notary charges in Germany, this is the only fair recommendation we can make.
